FotoDrop Terms of Service — EU

Website: fotodrop.eu
Prepared: 16 October 2026
Version: english-launch-2026-10-16-v7-withdrawal-review-source-prepared

These Terms apply to the Free album and optional one-time purchases of FotoDrop cloud software on this website: Mini, Full, eligible add-ons, and Event Kit Base or XL. School products are not offered under these Terms. The selected service description and order confirmation form part of your contract. The Refunds and Withdrawal Policy supplements section 3c below.

This is FotoDrop’s EU-facing website, with EUR catalogue prices and the EU album-storage arrangement described in the Privacy Notice. The protections that apply to you depend on the applicable law, not just the domain you choose.

We intend to make FotoDrop available worldwide, subject to applicable law, including EU sanctions and special export controls, and the actual restrictions of the payment and service providers used for a transaction. Restrictions may concern a particular person, product, activity or transaction; a country name alone does not establish that this service is prohibited. Checkout availability does not certify that every use or destination is legally permitted.

1. Who provides FotoDrop

Martin Žídek, trading as FotoDrop
Business identification number (IČO): 73767018
Registered address and address for correspondence and complaints: Počernická 514/54, 108 00 Praha 10 – Malešice, Czech Republic
Registered in the Czech Trade Register; registration authority: Prague 10 Municipal District.
General, privacy and legal enquiries: [email protected]
Product support, complaints, withdrawal and refunds: [email protected]\

The service and written support are provided in English. Mandatory language rights remain unaffected.

FotoDrop is responsible for operating the album service and for its product obligations. The separate payment and merchant-of-record arrangements are explained in section 3b; they do not remove your rights against FotoDrop.

2. Using the service and forming your contract

FotoDrop lets an event host collect and share photos and eligible videos through an album link or QR code. Guests can use the supported upload workflow without creating a FotoDrop account or installing an app. The host supplies an email address and uses a sign-in link to manage albums.

A modern browser, JavaScript, cookies or other storage necessary for the requested functions, and an internet connection are required. File formats, file-size and video-duration limits, and any feature-specific browser requirements are shown in the upload interface or service description. You pay your own internet and device costs. Test your browser, network and intended display equipment before an event; this does not affect our responsibility to supply what was agreed.

Hosts and purchasers must be at least 18 and have legal capacity to enter the contract, including any higher age of majority that applies to them. A person acting for an organisation must be authorised to do so. Direct guest use is intended for people aged 16 or over who may lawfully use the service. Children below that age must not operate their own upload session; an adult may use the service themselves to share lawful family photographs. These rules do not replace any parental authorisation or other protection required by law.

The Free service contract starts when you accept these Terms in the album-creation process and we create your album. A paid order is concluded when your payment is successfully accepted and your order is confirmed; the confirmation identifies the purchase and contract date. A pending payment, card authorisation or browser return alone does not establish successful payment or delivery. Before submitting an order, you can review and correct the details. If money is collected but we cannot supply the purchase, we will arrange a refund without undue delay.

Guests must be given access to these Terms and the Privacy Notice before uploading. By actively submitting an upload after that notice, a guest accepts the rules relevant to uploading and sharing. Simply viewing a page is not consent to marketing or optional analytics.

Keep host sign-in links, management access and encryption keys private. Paying for an album or add-on does not, by itself, give the purchaser host-management rights. Where guest purchases are available, the purchased benefit applies to the selected album and may be used by its host and other permitted users.

Albums and accounts on fotodrop.eu and fotodrop.online are separate. Creating or paying for an album on one site does not create, migrate or extend an album on another site. There is no storage-location selector or automatic transfer between sites.

3. The Free album

Feature Free allowance
Photos Up to 100
Videos Not available
Hosting 14 days from the first successful upload
Album with no successful upload Expires 365 days after creation
Payment No charge, subscription or automatic conversion to a paid plan

Photos are prepared in the browser, including resizing to a maximum long edge of 4,000 pixels and minimising metadata. FotoDrop does not promise to retain the untouched original camera file. This photo-processing description is not a promise that videos receive identical processing. See the Privacy Notice.

Printable QR materials are digital files for you to download and print. FotoDrop does not supply physical printing or delivery through this website.

3a. Optional cloud-service purchases

Product Main allowance and hosting period
Mini Up to 500 photos, 10 videos and 30 days of hosting
Full 90 days of hosting, with no ordinary photo or video count cap, subject to the disclosed storage, individual-file and video limits
Eligible add-ons The specified extra capacity, hosting time, storage or software feature shown in the order
Event Kit Base One independently managed event workspace, 180 days of hosting and 50 GiB of storage
Event Kit XL One independently managed event workspace, 180 days of hosting, managed fair use and one controlled live wall

The pricing page and order summary identify the features and practical limits of your purchase. They explain when its hosting period starts and, for an existing album, its resulting expiry date or how that date is calculated. A hosting period is not necessarily additional time on top of an existing period. An event date entered for organisational purposes does not itself postpone the hosting start unless the order expressly says so.

Extra storage alone does not extend hosting. Guestbook purchases require an eligible Full album. Other add-ons are available only for the plans and album states identified in the purchase interface. A Mini-to-Full upgrade credits the site's Mini plan price as shown in the upgrade quote; it does not charge the Full price again without that credit. These Terms do not offer a separate Base-to-XL upgrade.

Event Kit sections and QR upload targets belong to the same workspace; they are not separate independently hosted workspaces. FotoDrop provides automated software, not admission to an event, event management, on-site staff, equipment, bespoke consultancy or a live wall operated by FotoDrop personnel.

“Managed fair use” does not mean unlimited storage, bandwidth or simultaneous use. It permits genuine use for the event covered by the workspace, within the practical restrictions disclosed before purchase. Using the workspace as unrelated general-purpose file storage, reselling hosting, bypassing technical limits or deliberately overloading the service is not permitted. We will not impose an undisclosed retrospective storage charge or arbitrarily reduce the agreed service. Except where urgent security or legal action is necessary, we will explain a material fair-use issue and give you a reasonable opportunity to resolve it. If we cannot supply the agreed lawful use, the service remedies in section 8 apply.

3b. Payment, prices and access

Purchases are one-time charges, not recurring subscriptions. There is no automatic renewal. Additional hosting or features require a separate purchase.

Catalogue prices on this site are in EUR. Consumer prices and the final checkout total include applicable taxes and compulsory charges. Where a tax adjustment depends on information you provide, the final amount is shown before the payment-binding action. Stripe/Link may offer an optional buyer-local currency; review the currency, exchange-rate information and actual total before paying. A catalogue price is not a currency-conversion quote. Any separate fee imposed by your bank is not a FotoDrop fee.

Eligible orders use Stripe Managed Payments and are presented as “Sold through Link.” Stripe identifies Sold through Link, LLC as the entity providing its merchant-of-record service. The applicable transaction entity, including any regional affiliate arrangement, is disclosed in the checkout and transaction documents. The Sold Through Link purchase terms apply to that transaction relationship. FotoDrop remains responsible for the software, delivery of its features, product support and compliance with its own obligations.

Stripe/Link collects the payment and billing information required for the transaction, handles the applicable transaction receipts, invoices and credit notes, and provides transaction support. We do not require you to obtain a second FotoDrop tax invoice for the same Managed purchase. Tax treatment depends on the transaction and destination; no statement here promises that every country or product is supported.

FotoDrop verifies successful payment before applying paid access. If payment succeeds but the purchased benefit does not appear, contact [email protected]. We will investigate rather than ask you to pay again for the same benefit.

We provide an order and service confirmation in a form you can retain, including the purchased service, charge, your immediate-start choice and the full texts of the applicable policy documents, each identified by its version. Stripe/Link transaction messages and FotoDrop service messages are separate. You may request a copy of the applicable contract information from support.

For payment or transaction-refund assistance, you may also contact Link transaction support. Contacting FotoDrop is sufficient to start a request to us; we will not make you exhaust a separate provider complaints process first.

3c. Immediate service, withdrawal and refunds

FotoDrop supplies an ongoing cloud service. You may expressly request immediate access before any withdrawal period ends. Starting access, uploading media, activating an add-on or downloading an included QR file does not by itself remove your statutory withdrawal rights. We do not obtain a digital-content waiver for these cloud-service purchases or rely on automatic activation as full performance.

If you are a consumer, you have 14 days after the service contract is concluded to withdraw without giving a reason. This period concerns each paid purchase, not the date the original Free album was created. You can withdraw from the Free album contract within the same period and in the same ways. Nothing is refunded; we close the album after giving you the chance to download its photos and videos. The detailed instructions, possible extensions and model withdrawal form are in the Refunds and Withdrawal Policy.

If you withdraw as a consumer after expressly asking us to start the service during the withdrawal period, you pay a proportionate amount for the service provided until you withdraw, and we refund the rest: refund = price × (1 − elapsed days ÷ total hosting days). The price is the total price of the contract, not a split by item. Elapsed days run from activation of the purchase until we receive your withdrawal notice, and every started 24 hours from activation counts as one day. Total hosting days are the days of hosting the contract covers; before the first upload starts the hosting clock they are the elapsed days plus the purchased hosting days, and an extension bought on its own counts only from when it starts. Your right of withdrawal lasts for the withdrawal period and ends earlier only if the whole paid hosting period runs out within it. The Refunds and Withdrawal Policy explains the calculation with examples. Any longer period, later starting point or more favourable applicable provider remedy remains available.

Unused paid benefits: 14-day refund guarantee. Separately, for personal and business purchases, we guarantee a full refund of the amount paid for the purchase if you send your request within 14 days after the contract was concluded and have not used its purchased paid benefits.

Paid-benefit use means actual use of the particular purchased capability, additional capacity or hosting. Examples include exceeding the capacity available immediately before purchase, actually using a purchased slideshow or guestbook, collecting media or using event features in an Event Kit, or using hosting beyond the previously available hosting period. Buying, paying, automatic activation and activity already allowed under the previous entitlement do not, by themselves, count. A benefit may be used by the host or other permitted album users, not only the payer. Ambiguous evidence is not treated as proof of use.

Using a paid benefit may affect the voluntary unused-benefit guarantee, but is not a reason to refuse a statutory withdrawal or a remedy for a defective service. The 14-day guarantee does not set a deadline for reporting faults. There is no unconditional 60-day money-back guarantee; Link may separately provide remedies under its own terms.

To withdraw or request a refund, use Withdraw from contract here, email [email protected], write to our postal address, or contact Link transaction support. You may use the model withdrawal form in the Refunds and Withdrawal Policy, but it is not compulsory. An unequivocal notice sent before the deadline is sufficient; our approval need not arrive before the deadline.

We arrange reimbursement without undue delay and, for statutory withdrawals and requests qualifying for our unused-benefit guarantee, no later than 14 days after receiving the request, unless a shorter mandatory period applies. We refund through the original payment method unless you expressly agree to another method that creates no cost for you. Applicable tax paid on the refunded purchase is included. We do not deduct our payment-processing fees.

A request, acknowledgement or pending provider status is not evidence that a refund has completed. We track the result and address failures. Provider processing does not extend a legal reimbursement deadline. The bank's subsequent statement-posting time may differ.

Cancellation ends the refunded paid entitlement, not your ownership of your photographs. We explain any effect on the album, shared capacity and remaining purchases. We do not automatically erase an entire album because one add-on is refunded. Where capacity or hosting would become insufficient, we arrange a proportionate, privacy-preserving way to retrieve eligible content and close or adjust the affected service. This does not extend ordinary hosting indefinitely. Statutory content-retrieval rights remain available, and copies already saved outside FotoDrop are not deleted.

4. Sharing, visibility and encryption

Unless a more restrictive access mode is enabled, an album is accessible to people holding its link or QR code. A recipient may forward the link or save media. Choose recipients carefully, and do not treat an unlisted URL as authenticated access. Customer albums and media are excluded from public sitemaps and use search-indexing protections, but we cannot control every external crawler or a recipient's actions.

Eligible private-collection features keep unpublished content from other guests. The host controls publication; uploaders may see their own supported upload history. A live wall or slideshow may show selected content to everyone who can see the screen. Hosts must give appropriate notice of that audience and obtain any permission required for the display.

Where optional browser-side encryption is enabled for photos, the complete sharing link carries the decryption key. Anyone holding that key-bearing link can decrypt the photo content their access permits. Recovery through the host account depends on saved recovery information remaining available. This is not a promise of provider-inaccessible or “zero-knowledge” storage. The recovery arrangement, account information and operational metadata remain relevant to security. Do not assume that videos, captions, guestbook entries or other data receive the same encryption as photos. The Privacy Notice explains the scope.

5. Your content and responsibilities

Upload only content you are entitled to share, and respect the privacy, image, copyright and other rights of the people concerned. Hosting an event or buying a plan does not automatically give you permission to publish photographs of every attendee. In particular, take appropriate care with children and with sensitive situations.

Illegal content, child sexual abuse or exploitation material, non-consensual intimate imagery, threats, harassment, infringement of others' rights, malicious files and attempts to compromise the service are prohibited. FotoDrop is not an adult-content hosting service. Do not use it for pornographic content, unlawful surveillance, biometric identification, or collecting regulated records unrelated to an event album.

You retain ownership and other rights in your content. You give FotoDrop a non-exclusive, royalty-free licence only to receive, store, technically process, resize, transmit, display and make your content available as necessary to operate the features and sharing choices you request. Our service providers may perform those operations on our behalf. This permission lasts only for the relevant service and permitted deletion/recovery period, or strictly necessary lawful preservation. It is not a licence for advertising, independent commercial exploitation or AI training. Your upload does not transfer copyright to other users.

The host may remove content from the album. Guests can remove their own uploads during the supported 60-minute window using the same browser access. That interface window does not limit a legal erasure request, copyright complaint, privacy objection or content report; contact the host or FotoDrop afterwards.

Hosts decide the purpose and audience of their album. Organisational or professional hosts must provide appropriate information to attendees and establish the permissions or other lawful grounds their use requires. The Event Data Processing Addendum forms part of these Terms where FotoDrop processes hosted personal data on a host's behalf. It is not a school-services agreement or a guarantee of compliance for the host's event.

6. Reports, moderation and review

Report suspected illegal content using the content report form or [email protected]. Identify the specific content or URL, explain why it is unlawful, and provide your name and email where appropriate, together with a statement that you believe the report is accurate and complete. Identification is not required where the law provides an exception, including certain reports of child sexual abuse material. Do not download, attach or redistribute suspected illegal imagery to make a report, and do not send host sign-in links or encryption keys.

We acknowledge a sufficiently contactable report without undue delay, assess it diligently and impartially, and communicate the outcome and available review options where required. The same contact address is our electronic contact point for users and authorities under the Digital Services Act. Communication is possible in English or Czech and is not restricted to an automated chatbot.

Automatic file-format, size and abuse/rate-limit checks help protect the service. Hosts moderate their albums. FotoDrop reviews reports and may restrict particular content, uploads, sharing or accounts where necessary to enforce the law or these Terms. These safeguards do not mean that we pre-screen every upload or use AI to analyse customer media. We consider the seriousness and context of the issue and use proportionate measures.

When required, we give the affected user a statement of reasons identifying the action, relevant facts, legal or contractual ground, any use of automated means, and available redress. An immediate restriction may be necessary for safety or to comply with a legal order. We notify users unless prohibited by law or a lawful investigation or safety restriction.

You may request a free human review of a FotoDrop moderation decision by emailing the contact point, identifying the decision and explaining your concern. Send the request within six months of the decision where possible; this does not shorten any longer legal right. We correct unjustified restrictions and explain the outcome. Rights to a competent authority, an applicable statutory dispute-resolution mechanism or a court remain available.

Where we become aware of information giving rise to a suspicion of a criminal offence involving a threat to a person's life or safety, we report it to the competent authorities as required by law. Our contact channels are not emergency services.

7. Expiry, deletion and ending use

Download the photos and videos you wish to keep before hosting ends. We send the host a reminder seven days before expiry; email delivery cannot be guaranteed. The expiry displayed in album management remains important even if an email does not arrive. We do not promise automatic delivery of a complete album archive by email.

At expiry, normal guest and host access closes. Content then has a 30-day recovery grace period before it becomes eligible for permanent deletion. This is not 30 additional days of ordinary viewing or downloading. A hosting extension is available only while the content remains recoverable and the purchase interface permits it. A later purchase cannot restore permanently erased content.

A host-requested album deletion immediately stops normal guest access and places the album in recoverable trash for seven days. The host may restore it within that period; restoration does not extend its original hosting period. After the recovery window, the lifecycle process permanently erases content. Our ordinary cleanup target is within 30 days after the applicable recovery window ends, subject only to a specific lawful preservation requirement. Residual recovery copies are handled as described in the Privacy Notice and are not kept for ordinary use.

Deleting an album and erasing a host account are different actions. You may request account erasure through [email protected]; we explain and confirm the treatment of any remaining albums. Keeping necessary transaction records does not authorise us to retain the album's media indefinitely.

You can stop using the service at any time. Early cessation or deletion does not itself request a refund; use section 3c so we can identify the transaction. We may end or restrict use for a material breach, a legal requirement, or a serious security risk, following section 6 where relevant. We do not cancel an agreed paid term merely for convenience without preserving your rights and refunding the unsupplied portion. When lawful and technically possible, we give reasonable notice and an opportunity to retrieve content. Mandatory content-retrieval and refund rights take precedence over ordinary lifecycle rules.

8. Service quality, problems, complaints and liability

We must supply the service as described and with the conformity, reasonable care and skill, functionality and security required by applicable law. For continuously supplied digital services, this includes conformity during the agreed supply period and required updates, including security updates. A lack of an uptime percentage is not an exclusion of those obligations.

We work to keep FotoDrop available, but cannot guarantee uninterrupted operation. Keep independent copies of important media. We are not a permanent archive or an emergency service. These statements do not excuse a failure for which we are legally responsible.

For a problem, email [email protected] with the order or non-secret album identifier, what happened and the remedy you request. Do not email sign-in links, passwords or encryption keys. We acknowledge the complaint and provide its outcome in writing. We resolve consumer complaints within 30 days unless you expressly agree to a longer lawful period; a shorter mandatory deadline or a requirement to remedy without significant inconvenience takes precedence.

Where the service is not supplied or does not conform to the contract, applicable remedies may include supply or correction free of charge, a proportionate price reduction, termination and reimbursement. Immediate termination or a price reduction may be available where a problem is serious, cannot be fixed, persists, or is not remedied in the legally required time. You do not have to accept repeated unsuccessful fixes. Compensation and other mandatory remedies remain available. Neither expiry nor the voluntary refund deadline limits the period in which a legal claim may be made.

For EU/EEA consumers, mandatory digital-service conformity and content-retrieval rights remain in force. We do not exclude those rights because an album was Free where the applicable legislation protects that service, or because the purchased service was intended for a wedding or other dated event.

Nothing in these Terms excludes liability for fraud, wilful misconduct, gross negligence, death or personal injury where exclusion is prohibited, infringement of mandatory data-protection rights, or any other liability that cannot lawfully be limited. We do not impose a general purchase-price liability cap, mandatory arbitration, or a class-action waiver in these FotoDrop Terms. Our responsibility and any recoverable loss are otherwise determined by applicable law. You are not required to indemnify us for our own breach or negligence.

9. Privacy and contact

The Privacy Notice explains our handling of personal data, cookies, optional measurement, retention, service providers and your rights. It is an information notice, not blanket consent to processing. Optional marketing and analytics require their own choices. Contact [email protected] for privacy matters or content reports and [email protected] for the product and purchases.

10. Governing law and resolving disputes

Czech law governs the contract with FotoDrop. If you are a consumer, this choice does not deprive you of any mandatory protection that applies under the law of your habitual residence or any other applicable law. You may use the courts and consumer-redress bodies available under mandatory jurisdiction rules; we do not require every consumer to sue only in Prague. A business dispute is dealt with by the court competent under applicable procedural law unless a separate valid agreement provides otherwise.

Please contact us so we can try to resolve the issue; this does not restrict your right to use a regulator or court where available. For an eligible consumer dispute concerning FotoDrop's service, you can apply to the Czech Trade Inspection Authority (Česká obchodní inspekce), Central Inspectorate — ADR Department, Gorazdova 1969/24, 120 00 Praha 2, Czech Republic, email [email protected]. See its ADR information. We cooperate with the competent ADR process as required by law; this does not commit either party to binding arbitration. Eligibility and procedural deadlines are set by that body. This route is separate from a complaint concerning Stripe/Link's own payment services.

For an eligible cross-border European consumer dispute, your national European Consumer Centre may also assist. You do not have to use an online dispute-resolution platform before contacting the competent ADR body.

11. Changes and interpretation

The version supplied with your purchase governs that purchase. We do not retrospectively reduce agreed capacity, hosting, refund rights or other material paid benefits by changing a web page. New versions normally apply to future purchases. Any change to an ongoing digital service must have a valid reason, such as security, compliance or technical maintenance, and follow applicable notice and consumer-termination requirements. A materially adverse change is not imposed solely by treating silence or continued use as acceptance where express agreement is required.

Where a material change lawfully applies to an existing service, we explain it in advance on a durable medium when required, including any right to end the affected service without charge. Essential urgent security or legal changes may require shorter notice. Privacy changes cannot create consent to a new purpose.

If a provision is unenforceable, the remaining provisions continue where legally possible; this does not permit us to rewrite an unfair provision to your disadvantage. Mandatory law prevails. Within these FotoDrop documents, the Refunds and Withdrawal Policy governs the detail of refunds, and the Event Data Processing Addendum governs processing on a host's behalf. The order description fixes the purchased service, not a later version of the pricing page. No document limits a more favourable mandatory right or an applicable Link remedy.

12. Export and switching

The host may retrieve their exportable content, move it to another provider or their own storage, or request deletion instead of switching. Send a request to [email protected]; no advance notice period is required to start the process. A switching request must come from the host or an authorised representative, not simply from someone who paid for an add-on. This does not limit an individual's separate data-protection rights.

We provide reasonable assistance and cooperate in good faith with you and an authorised destination provider. We begin without undue delay and complete our export and switching assistance within 30 calendar days of your request. You may extend the transition once by telling us the period reasonably needed for your migration; mandatory rights to an extension are preserved. We explain known technical limitations and maintain the agreed service, security and continuity during the transition. We do not impose an additional migration, data-egress or early-termination fee, or a new hosting purchase solely to complete a timely requested transition.

The exportable categories are the media files held for your album or workspace; captions and guestbook contributions; album/event names and setup details; section membership and organisation; media identifiers, file types, sizes and retained upload/capture timestamps; visible reaction totals and other customer-facing records generated by your use; your configured access/publication settings; and your generated QR/printable files and customisation data. The export includes the categories actually present for your service, in their stored media formats and, for structured information, commonly used machine-readable formats such as CSV or JSON, with information explaining the fields. It does not recreate an original camera file that was never stored. Secure export must respect other people's rights and any lawful restriction on the content.

The categories excluded as FotoDrop internal information are proprietary application source code and infrastructure configuration; provider credentials and secret signing material; internal anti-abuse detection rules and security intelligence; other customers' information; and internal payment reconciliation records that are not your exportable service data. Your own receipts and personal-data rights remain available separately. A general claim of confidentiality is not used to withhold your exportable content or obstruct switching. Host sign-in tokens and other credentials are not placed in an ordinary export archive. Where photo encryption applies, we explain how you can export decrypted media or securely retain the information needed to read your files; never give a destination provider your host sign-in link.

The affected service contract ends when the switch is successfully completed and we confirm that completion. After the transition, you have at least 30 calendar days to retrieve the exportable data through a secure retrieval route. This retrieval period does not promise continued public gallery or live-wall operation. We do not delete the material needed for an accepted switching request merely because the ordinary album expiry occurs during that process. At the end of retrieval, or a later date specifically agreed with you, we erase the exportable data and digital assets remaining under our control, subject only to a specific mandatory legal preservation obligation. Where applicable law requires erasure sooner than an ordinary recovery-copy schedule, that legal deadline takes priority. You can instead request earlier erasure. A deletion-only termination takes effect without an advance notice period, with the selected recovery/erasure instructions explained before irreversible action.

Ordinary use of a download function does not itself terminate the service. Ending the service to switch is not, by itself, an additional refund entitlement; withdrawal, defects, unsupplied service and other mandatory refund rights remain as set out above. We do not promise to reproduce FotoDrop's interface or features in another provider's product or to log in to your external cloud account. Technical information about available export methods, formats, relevant limitations and your responsibilities is available before purchase and during switching. These arrangements apply on this site without reducing any stronger rights under the EU Data Act or other applicable law.
